A way for commoners to change society, Corruption & Public Interest Report

The reporter protection system helps to eradicate corruption through prompt handling of reported cases and
thoroughly protect reporters so that anyone can report without fear.

Violations subject to report

  • Act of corruption

    • Any acts of any public official's abusing his or her position or authority or violating statutes or regulations in connection with his or her duties to seek personal gains; Any acts of inflicting damages on the property of any public institution in violation of statutes or regulations
  • Act detrimental to the public interest

    • Any acts detrimental to the health and safety of the people, the environment, the interests of consumers, fair competition, and public interest equivalent thereto (child abuse, manufacture of adulterated foods, etc.)
  • Fraudulent receipt of welfare and subsidy

    • Any act to receive public subsidy or to enjoy social welfare service from central or local governments by fraud or in an illegal way.
  • False claim, etc. for public funds

    • An act of falsely claiming or excessively claiming public funds; An act of using a payment from public funds for any purpose other than the specified purpose; Any case where a payment from public funds is made erroneously;
    • Payment from public funds : a subsidy, compensation, or contribution provided from public funds pursuant to statutes and regulations, or other money or valuables, etc.(money, bonds, goods, etc.) offered without any substantial return as prescribed by Presidential Decree
  • Violation of the Improper Solicitation and Graft Act

    • Any improper solicitations to any public servant, etc. directly or through(for) a third party; Any act of a public servant, etc. to perform his/her duties as solicited; any act of a public servant, etc. to receive, request, or promise prohibited money or valuables. etc.
  • Corrupt hiring practices

    • Any act to hamper fairness of hiring by violating laws and regulations, guidelines, articles of incorporation, or by-laws; or by gross negligence, in order to unduly influence the employment of oneself or the third party.
  • Violation of the Code of Conduct for Public Officials

    • Any act to violate behavioral standards that public officials should comply with (reporting private interest, prohibiting profit-making activities related to public duties, prohibiting private labor demands, prohibiting illegal acts that exercise duty-related authorities, etc.)

Public Interest Violation Reports

The purpose of the Protection of Public Interest Reporters Act is to contribute to the stabilization of the livelihood of citizens and the establishment of a transparent and clean social climate by protecting and supporting those who have reported any act that is detrimental to the public interest.

What is an act detrimental to the public interest?

It is any of the acts detrimental to the health and safety of the people, the environment, the interests of consumers, fair competition, and public interest equivalent thereto, and falling under the penalty provisions or administrative measures of the acts subject to public interest reports.

A total of 471 acts such as “Special Act on the Safety Control and Maintenance of Establishments,” “Food Sanitation Act,” “Natural Environment Conservation Act,” and “Medical Service Act,” etc. are subject to public interest reports.

Agencies receiving public interest reports

  • Article 6 of the Protection of Public Interest Reporters Act Four agencies receiving public interest reports

    • Representative of a corporation
      • A representative or employer of a person, institution, organization, or corporation that commits an offence detrimental to the public interest
    • Inspection agency
      • An administrative or supervisory agency with the authority to guide, supervise, regulate, or investigate acts detrimental to the public interest
    • Investigative agency
      • A prosecutor, A normal &special judicial police officer
    • The ACRC
  • Article 5 of the Enforcement Decree of the Protection of Public Interest Reporters Act

    Two agencies receiving public interest reports
    • Member of the National Assembly
    • Public organization
      • A public corporation established pursuant to Acts related to acts detrimental to the public interest

Proxy report can be made through an attorney-at-law for a public interest report.

A whistleblower can be supported by the ACRC’s advisory group for proxy report specialized for each field, to receive free legal advice and disclosure by proxy.
