Disciplinary actions to be toughened against public officials engaging in graft

ACRC revised guidelines on the Code of Conduct for Public Officials

The ACRC revised the Guidelines on the Operation of the Code of Conduct for Public officials to toughen the disciplinary standards for the public officials who give or receive money, valuables, and entertainment in violation of the code of conduct.

The revised guidelines have strengthened the 'disciplinary standards on the violations of restriction of giving/receiving money and valuables, etc.' in order to apply the strict standards of public officials to the employees of public-service related organizations.

* Categories of disciplinary actions against public officials (State Public Officials Act): light disciplinary actions (reprimand and reduction of salary); severe disciplinary actions (suspension from office, demotion, dismissal and removal)

**Public service-related organizations: government-invested, contributed or subsidized institutions and organizations, and other institutions and organizations conducting governmental tasks under the entrustment of the government


The Code of Conduct for Public Officials prohibits public officials from receiving money, valuables, and entertainment from duty-related persons or duty-related public officials. It also bans public officials from giving money, valuables, and entertainment to other public officials, such as their superiors or persons in charge of human resources, who could give them advantages or disadvantages as a direct result of their performance of duties.

Previously, if a public official received money, valuables, or entertainment of less than KRW 1 million from a duty-related person, the official was subject to 'reprimand' or 'reduction of salary.' According to the revised guidelines, he or she will be subject to disciplinary actions ranging from 'reduction of salary' to 'dismissal.'

In addition, if a public official requests and receives money, valuables, or entertainment of more than KRW 1 million in relation to his/her performance of duties, the official will be removed from office.

The Code of Conduct for Public Officials is applied to the public officials of more than 1,300 public organizations, including national and local government agencies and public-service related organizations such as public companies. Each public organization is required to refer to the disciplinary standards for punishment of public officials who gave or received money, valuables, and entertainment in violation of the code of conduct.
